Law and economics at the crossroads of the energy transition

The commitment of Europe and its Member States to the fight against climate change is profoundly shaping the energy policies that must support the energy transitions needed to achieve the objectives of reducing greenhouse gas emissions.

The electricity sector is one of the major pillars of these transitions, with objectives to decarbonise the electricity mix. The result is a significant increase in the capital intensity of the electricity system, against a backdrop of sustained technological development: the stakes are high for competitive decarbonisation to ensure security of supply. It is becoming increasingly clear that the right economic incentives need to be put in place so that players faced with a competitive and changing environment can make the decisions that will enable them to deliver the right level of investment, in a context where the different geographical meshes need to be articulated more than in the past, and where responsibilities and risks need to be properly allocated between players.

The energy transition thus calls for a cross-fertilisation between economics and law in order to link the different levels of regulation with the different levels of public policy decision-making and to ensure that market players are effectively incentivised to support the fight against climate change.
