Insurance companies, mutual insurers and provident institutions offer insurance policies to the public, but the framework governing these activities differs from one player to another. For example, when mutuals cover property damage and civil liability risks, they come under the Insurance Code. When they cover risks relating to the human person, they come under the Mutual Code. In addition, there is a tendency for the activities of insurance companies to be increasingly regulated. The examples of the ANI and the zero out-of-pocket payments for dental, optical and hearing care underline this for supplementary health insurance, which is also a favourite area for mutual insurers, accounting for more than half of all contributions.
Partly in response to these regulatory challenges, but also to ensure greater financial strength in the face of competition, a trend towards concentration among mutuals has been observed for several years. This has contributed both to exacerbating competition between mutuals, insurance companies and provident institutions, and to increasing regulatory pressure, particularly on issues of solvency and governance.
In this context, how do the diversity of statutes and the specific features of mutuality interact with the public authorities' desire to open up competition for the benefit of consumers between players of quite different sizes, business models and balance sheet structures? More generally, how does sector regulation relate to competition issues in the various insurance segments in which mutuals operate?
Drawing on the views of a representative of the mutual insurance industry, a sector specialist and a sector regulator, the round table will consider these various points and complement the contributions to the round table on "The regulation of the social and solidarity economy" organised by the Chair on 5 October 2017.
