Redefining the Relationship of Economic Regulators to the Political Process: The Future of 'For Cause' Removal Protections in the United States
In 1935, in the Humphrey's Executor case the US Supreme Court ruled that President could remove members of the Federal Trade Commission only for good cause. On December 8, the Supreme Court will hear arguments in a case (Slaughter v. Trump) that challenges the validity of this 90-year-old principle. Many commentators expect that the Court will endorse the view that the President has unlimited discretion to dismiss FTC commissioners, or the members of other historically independent agencies. This presentation will consider what happens to the regulatory state if the for-cause removal protection evaporates.
