The recent period of inflation has put many operators of public service delegations or infrastructure managers in difficulty, particularly in the water, transport, waste and district heating sectors. Exposed to rising wages and energy prices, many of them have been unable to pass on these increased costs to their customers, either because there are no contractual clauses providing for such a pass-through, or because there are clauses limiting the amount, or because they have been unable to persuade their regulator to take this into account in the level of remuneration for their regulated asset base.

To discuss these difficulties and consider ways of dealing with this new situation, the Governance and Regulation Chair hosted a breakfast debate on 11 January 2024 from 8.30am to 10am with three guests:

  • Pierre Agache, Director of Tariffs, Regulation, Finance and Subsidiaries, Electricity Transmission Network (RTE France)
  • Jordan Cartier, Secretary General, Transport Regulation Authority (ART France)
  • Dominique Jamme, Director General, French Energy Regulatory Commission (CRE)

The debate was moderated by Christine Le Bihan-Graf, Partner of the law firm De Pardieu Brocas Mafféi.
