Old and New Regulatory Instruments in the Digital Markets Act
As the DMA moves into implementation, it is a good moment to analyze the regulatory instruments in the Regulation to ensure effectiveness in the application of the new obligations on gatekeepers. While some instruments are well-known (sanctioning procedure), and others are heavily influence by ex ante regulation in the network industries (rule making), there are new and innovative instruments rather linked to the compliance instruments in the data protection (short) tradition, as the compliance report. How will these instruments be combined? Might the result be a new form of public intervention?
